By accessing or using Empowerment Technologies Incorporated Software operating as DEFENDER (“ETI”) or the related Website/Mobile Application, you agree to be bound by the terms described herein and all terms incorporated by reference. If you do not agree to these terms, do not use the ETI or the related Website/Mobile Application.
Privacy is of utmost importance at ETI. We recognize the significance of protecting information which is stored on our computers or is intended to be stored on our computers and which relates to an individual. The data we protect are the “Personal Data” which is any information relating to an identified or identifiable natural person, sometimes called a data subject, and have made protecting privacy and the confidentiality of Personal Data a fundamental component of the way we do business. This Privacy Policy informs you of the ways we ensure privacy and the confidentiality of Personal Data. We are compliant with applicable privacy laws in the countries in which we operate. This policy describes the information we gather, how we may use those Personal Data and the circumstances under which we may disclose such information to third parties.

How we Collect and Use Your Personal Data
When you access or use the ETI Website/Mobile Application or Services, we may collect some information, including information that you directly provide to us and it identifies you personally, such as, without limitation, name, postal address, e-mail address and telephone number.
We may also automatically collect certain information as you navigate through the website or use our Services, such as usage details, equipment profiles and IP addresses, by means of cookies, web beacons and other tracking technologies.
We have set out below a description of the ways we may use your personal data, and which of the legal bases we rely on to do so. We have also identified what our legitimate interests are where appropriate. We will only collect the personal data that is necessary for its specified, concrete, explicit and legitimate purposes and not further processed in a manner that is incompatible with those purposes. You have the right to choose whether or not to provide the data we requested, but in most cases, if you do not provide your personal data, we may not be able to provide you with our services or respond to your queries.
Note that we may process your personal data for more than one lawful ground depending on the specific purpose for which we are using your data. Please contact us if you need details about the legal ground, we are replying on to process your personal data where more than one ground has been set out below.
Use of Defender Guard App and Devices
- When you sign up with the Defender Guard App for the first time, we collect your email address, the country or region you choose, your nickname (if uploaded), an encrypted password, and a profile photo (if uploaded). This data allows us to complete your registration, communicate with you, and administer your account. Uploading a profile photo and nickname is voluntary and does not affect the app's functionality. The lawful basis for processing is the performance of the Defender Guard Registration Agreement and our legitimate interests in maintaining our contractual relationship, providing services in compliance with your chosen country's legal requirements, ensuring product security, and keeping our products updated and relevant.
- When you change the details you used for registration, the new entries replace the old ones. This allows the requested changes. Refusal to provide such information only prevents the use of this function but does not affect other app functions.
- When you log in and use our services, we process data related to your terminal (e.g., smartphone), such as GPS, operating system, model, unique identifier, and MAC address. This data is used to offer and maintain our services, optimize them, and secure your account.
- When you add a device on the Device interface, we collect the device SN, QR code, model, Wi-Fi information, device name, precise geographical location, encrypted device password, time zone and DST status, and camera permission. This data processes your request to add and configure a device. Refusal to provide such information only prevents the use of this function but does not affect other app functions.
- When you use the Live View function, we collect the device SN, IP, port information, and video stream to provide real-time video display.
- When you use the Playback and Video Recording functions, we collect the device SN, channel ID, and record files path to store your history record and allow you to view it.
- When you activate and configure the settings of the added device, we collect the MAC address, IP address, device SN, model, firmware version, country information (via IP address), device location (via IP), registration date, channel information, offline/online status, and configuration information. This allows device activation and registration with our server.
- When you set the device name and cover image, we collect the cover image, device name, channel information, device model, and SN. This information allows you to set and change these details and informs you about the device added to your account. Refusal to provide such information only prevents the use of this function but does not affect other app functions.
- When you enter the device password or use the reset function, we collect the device SN, user name, email address, current encrypted password, and new encrypted password to enhance device security. Refusal to provide such information only prevents the use of this function but does not affect other app functions.
- When you use the Device Share function, we collect the device SN, user name, and email address of the user you share your device with. This data allows device sharing. Refusal to provide such information only prevents the use of this function but does not affect other app functions.
- When you use the Delete Device function, we collect the device SN and email address to remove the device from your account and matched accessory. Refusal to provide such information only prevents the use of this function but does not affect other app functions.
- When you receive notifications, we collect the device SN, unique identifier, MAC address, push notice ID, and alarm snapshot to send alarm notifications and provide requested services.
- When you use the Device audio collection function, we collect your user name, email address, and permission to access the microphone on the device. This allows audio data collection. Devices with microphones enable audio capture by default, but you can disable it. Turning off audio collection removes sound from real-time preview and recording.
- When you use the AI detention function, we collect event-based video recordings to improve AI detention accuracy for event-based video records. The lawful basis for processing is your consent.
- When you use the device, we collect the Media Access Control Address (MAC), network access method and type, operation log information, network log or device log information, error or abnormal service data, and system operating status and performance data. This data helps us solve failure problems and ensure the safe operation of devices and services. The lawful basis for processing is your consent.
- When you de-register from the Defender Guard App and cease using Defender devices and services, we collect your email address to complete deregistration and delete all personal data collected during your use. The lawful basis for processing is the performance of the contract.
- When we process device logs, we collect your user name, email address, device SN, and permission to access storage on the device to improve our app and services and provide a better user experience. The lawful basis for processing is your consent.
- When you save device label figures and names, we collect your user name, email address, device SN, and permission to access storage on the device. This allows you to save a QR code with device details on your terminal. The lawful basis for processing is your consent.
Cookie and other Technologies
Our website and apps use cookies and similar technologies. We use functional cookies to ensure that our website and services operate properly and analytical cookies to make your user experience optimal. Third-party cookies may collect data outside our websites as well. As you navigate through and interact with the website and our services, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, traffic data, logs and other communication data.
Our Privacy Policy does not cover the use of cookies by others, including, without limitation, our partners, affiliates, tracking utility company and service providers. We do not have access or control over these cookies.
Other Uses of Personal Data
Except as part of the sale of all or substantially all of the assets of Defender (in which case you will be given prior notice), ETI will not use your Personal Data unless we have your consent. We will only use and/or disclose Personal Data internally in order to Understand and meet your needs and preferences;
- Develop new and enhance existing service and product offerings;
- Manage and develop our business and operations;
- Carry out any purposes for which we have received your consent;
- Provide you with notices about your account, your Product and Service purchases, and/or updates to our terms and policies;
- Respond to your inquiries and/or provide you with customer service related to your purchase; and
- Meet legal and regulatory requirements.
We also reserve the right to use aggregated Personal Data provided that those data do not relate to any individual.
Moreover, Personal Data may be collected, stored and/or processed by third party service providers or by companies in the ETI corporate family to perform functions on our behalf. All such third parties will be contractually bound to protect data in compliance with our policy.
Except where we are required by law to disclose Personal Data or are exempted from, released from or not subject to any legal requirement concerning the disclosure of Personal Data, we will require any person to whom we provide your Personal Data to agree to comply with our Privacy Policy in force at that time or requirements substantially similar to such policy. We will make reasonable commercial efforts to ensure that they comply with such policy or requirements, however, we will have no liability to you if any person fails to do so.
We shall require any third party, including without limitation any government or enforcement entity, seeking access to data we hold to have obtained a Court Order, or proof they are statutorily empowered to access your data and that their request is valid and within their power.
Processing
We will process your Personal Data legally and fairly and not use it outside the purposes of which we have informed you. So far as we are able we shall ensure that all of your Personal Data is accurate and up to date.
Security Of Your Personal Data
We protect Personal Data with appropriate physical, technological and organizational safeguards and security measures. Your Personal Data comes to us via the internet which chooses its own routes and means whereby information is conveyed from location to location. As such we cannot give any warranty or assurance that the means where information is conveyed to us are safe, reliable or have integrity. We audit our procedures and security measures regularly to ensure they are being properly administered and remain effective and appropriate. Every member of ETI is committed to our privacy policies and procedures to safeguard Personal Data. Our site has security measures in place to protect against the loss, misuse and unauthorized alteration of the information under our control. More specifically, our server uses security protection by encrypting your Personal Data including credit card number, name and address to prevent individuals from reading these Data as it travels over the Internet. The length of time we retain Personal Data outside our back up system varies depending on the purpose for which it was collected and used. This period may extend beyond the end of the particular relationship with us but only for so long as we are contractually bound to do so, or so far as is necessary for audit or other accounting purposes. When Personal Data are no longer needed we have procedures either to destroy, delete, erase or convert it to an anonymous form. We reserve the right to maintain your Personal Data as part of our standard back up procedures.
Storage of Personal Data
Data provided to ETI is stored in accordance with applicable laws of the jurisdiction of the data subject, at secure locations. ETI has ensured that appropriate security standards are in place regarding the safeguarding, confidentiality and security of Data.
Withdrawal Of Consent
Except as required or enabled by law, we will not use or disclose your Personal Data for any purpose for which you refuse consent or later withdraw your consent. If you withdraw consent, you agree that in spite of this withdrawal, we may continue to use those Personal Data previously provided to us to the extent that we are contractually or otherwise legally obliged to do so and to the extent necessary to enforce any contractual obligation you may have towards ETI or in any other way permitted by law. You also understand that although you can use our Mobile Application for some purposes without providing Personal Data, we need certain Personal Data, including data linked to payment or involving an ongoing relationship with ETI or our partners. If you refuse to provide us with Personal Data we require or later withdraw your consent, we may no longer be able to provide you with certain services.

By using this site, you signify your agreement to this Policy. ETI reserves the right to change this Policy at any time. Any changes will be posted so that you are always aware of what information we collect, how we use it and under what circumstances we disclose it.
